1. Promotion Overview

The “Free Dank Summer” Promotion (the “Promotion”) is sponsored by Dank Burrito Franchise Group, LLC (“Sponsor”), located at 801 Arendell Street, Suites 1 & 2, Morehead City, North Carolina 28557. The Promotion runs from approximately 8:00 a.m. Eastern Time (“ET”) on June 1, 2025, to approximately 11:59 p.m. EafterT on August 31, 2025 (the “Promotion Period”). By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding.

2. Eligibility

The Promotion is open to legal residents of the 50 United States and the District of Columbia who are 13 years of age or older at the time of entry and are enrolled in the Dankster Rewards program. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian who agrees to these Official Rules. Employees, officers, directors, and immediate family members of the Sponsor, its affiliates, and their respective agencies are eligible to earn rewards points and achievements but are not eligible to win the Grand Prize or Max Earner Award. The Promotion is void where prohibited by law.

3. Promotion Opt-In

All Dankster Rewards members are automatically enrolled in the Free Dank Summer Promotion upon membership in the Dankster Rewards program, subject to the Dankster Rewards Terms and Conditions (https://www.dankburrito.com/rewards-terms). No additional opt-in is required. To participate, entrants must have a Dankster Rewards account, which can be created for free at https://www.dankburrito.com/rewards. Qualifying purchases must have a minimum value of $15 (before tax and tip) and be made at participating Dank Burrito restaurants in the U.S. using a Dankster Rewards account or via the Dank Burrito website or mobile app while logged into a Dankster Rewards account.

4. Promotion Details

During the Promotion Period, Dankster Rewards members can earn the following achievements and prizes by making qualifying purchases (orders of $15 or more before tax and tip, tied to their Dankster Rewards account):

• First Order Bonus: Awarded once per participant upon their first qualifying order during the Promotion Period. Reward: 300 bonus Dankster Rewards points and 1 entry into the Grand Prize drawing. Approximate Retail Value (ARV) of points: $30 (assuming 10 points per $1 spent, redeemable at standard rates).
• Repeat Bonus: Awarded each time a participant places a qualifying order within 7 days of their previous qualifying order. This achievement can be earned multiple times during the Promotion Period. Reward: 700 bonus Dankster Rewards points and 10 Grand Prize entries per achievement. ARV of points: $70.
• Monthly Bonus: Awarded at the end of each month (June, July, August) to participants who place 4 or more qualifying orders in that month. This achievement can be earned up to three times (once per month). Reward: 1,500 bonus Dankster Rewards points and 20 Grand Prize entries per achievement. ARV of points: $150.
• Max Earner Award: Awarded to the Dankster Rewards member who earns the most achievements (First Order Bonus, Repeat Bonus, and Monthly Bonus combined) without winning the Grand Prize. The winner will be determined within 30 days after August 31, 2025. Prize: $100 Dank Burrito gift card. ARV: $100.
• Grand Prize: One winner will receive a “Free Burritos for a Year” prize, consisting of a Dank Burrito gift card loaded with $780, equivalent to 52 burritos at an approximate value of $15 each. ARV: $780. The Grand Prize drawing will occur within 30 days after August 31, 2025.

Participants are limited to one qualifying purchase per day. Points and entries are credited automatically upon purchase, provided the order meets the $15 minimum and is tied to the participant’s Dankster Rewards account. Points expire after 180 days of account inactivity, per the Dankster Rewards Terms and Conditions.

5. Winner Selection and Notification

Grand Prize: One Grand Prize winner will be selected in a random drawing from all eligible Grand Prize entries received during the Promotion Period, conducted within 30 days after August 31, 2025. Odds of winning depend on the number of entries received. The potential winner will be notified via email, Dank Burrito app push notification, or phone associated with their Dankster Rewards account within 7 business days of the drawing and must respond within 48 hours to claim the prize, providing any additional information requested. If a potential winner does not respond, is ineligible, or cannot be contacted, an alternate winner may be selected.

Max Earner Award: The winner will be determined by calculating the participant with the highest number of achievements (First Order Bonus, Repeat Bonus, and Monthly Bonus) who did not win the Grand Prize. In case of a tie, the winner will be selected randomly from tied participants. The winner will be notified within 5 business days after determination and must respond within 48 hours. Non-compliance may result in forfeiture, and an alternate winner may be selected.

Achievement Rewards: First Order Bonus, Repeat Bonus, and Monthly Bonus rewards are credited automatically to the participant’s Dankster Rewards account upon meeting the criteria. No additional notification is provided for these rewards.

6. General Conditions

Prizes are non-transferable, non-assignable, and not redeemable for cash, except at the Sponsor’s discretion. The Sponsor reserves the right to substitute prizes of equal or greater value if a prize becomes unavailable. Participants are responsible for all federal, state, and local taxes associated with prizes. The Sponsor will issue an IRS Form 1099 or equivalent for the retail value of prizes as required by law. Personal information collected is governed by the Dank Burrito Privacy Policy (https://www.dankburrito.com/privacy-policy). The Promotion is void where prohibited. The Sponsor is not responsible for lost, late, or misdirected entries or notifications, or for technical failures affecting participation.

7. Arbitration Provision

By participating, each entrant (and any minor entrant’s parent or legal guardian) agrees that any disputes related to the Promotion, prize awarding, or these Official Rules will be resolved by final and binding arbitration under the rules of the American Arbitration Association (AAA) Consumer-Related Disputes Supplementary Procedures, as modified by this paragraph. The arbitration will be governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16), conducted in North Carolina, and apply North Carolina law. Arbitration is limited to individual claims, and class or representative claims are not permitted. The arbitrator’s decision will be based on these Official Rules and cannot award punitive damages. If arbitration costs are prohibitive, the Sponsor will cover filing and hearing fees as deemed necessary by the arbitrator. If any part of this arbitration provision is invalid, the remaining provisions will remain in effect. If the AAA is unable to conduct the arbitration, another national arbitration company may be used, adhering to these terms.
